Terms of Service.

Nithyam provides AI-assisted daily check-ins, alerts, reports, and onboarding workflows for families monitoring elderly parents in India.

The first month is billed at ₹499 as a trial. From month two onward, billing follows the selected plan (monthly, quarterly, half-yearly or annual). Service activation is tied to successful payment events.

Families must provide accurate senior contact information, emergency contact details where applicable, and notify Nithyam when phone numbers or care preferences change.

Accounts may be suspended for failed payments or misuse. Customers may cancel at any time from the dashboard; refund eligibility is governed by our Refund Policy.

Nithyam targets 90% monthly uptime measured as the share of scheduled check-ins and escalation calls that successfully dispatched. If uptime falls below 90% in a billing month, we automatically credit (1 − uptime) × monthly fee against your next invoice. The credit is applied automatically — no action required.

Counts as downtime: our WhatsApp send failed, our scheduled voice call was never placed, or our dashboard was inaccessible for more than 1 hour.

Does not count:WhatsApp or Meta platform outages; TeleCMI or other telephony-provider outages; scheduled maintenance of 2 hours or less announced at least 24 hours in advance; the senior's phone being off, unreachable or out of network; or the senior choosing to block the Nithyam number.

Nithyam is a monitoring and alerting service, not a medical provider, emergency responder, or insurance substitute. Families remain responsible for emergency action. Nithyam's liability in any billing month is limited to the fees paid for that month.

These terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of courts in Andhra Pradesh, India.
